Order The plaintiff appeals from summary judgment for the defendants in this action brought pursuant to Section 301 of the Labor Management Relations Act, 29 U.S.C. § 185, charging his employer with wrongful discharge and the union with the breach of its duty of fair representation. After considering the supporting affidavits and other exhibits filed by the defendants the district court concluded that no material issues of fact were presented. Upon considering the record on appeal this court concludes that the district court properly decided the issue presented and that summary judgment was appropriate. There was no showing that the employer departed from the terms of the collective bargaining agreement and the record indicates that the plaintiff was far from diligent in seeking to protect his employment rights. Likewise the record shows that the union pursued the plaintiff's complaint and carried it through the grievance procedures to the point just short of arbitration. At that point the union was able to work out a compromise by which the plaintiff would be reinstated without loss of seniority, though he would be denied the right to contest punishment, but not guilt, with respect to any charges which might be brought against him within one year.
